These Terms of Service ("Terms") govern your use of the website ebygautomation.com and all products and services offered by EBYG Automation, a division of EBYG Media LLC ("we," "us," or "our"). By accessing our website or purchasing our products and services, you agree to be bound by these Terms.

1. Services Overview

EBYG Automation provides:

• Digital products (AI Starter Kit, AI Automation Blueprint, Small Business AI Toolkit) sold under the EBYG Automation brand
• AI implementation services (Jeong Assistant, Jeong Operations Agent, Jeong Workforce System) sold under the Jeong AI brand
• Ongoing support services (Jeong Support Plan) provided on a monthly subscription basis

Specific deliverables, timelines, and pricing for implementation services and support plans are defined in individual client agreements.

2. Digital Products

Purchase and Delivery

Digital products are delivered electronically after payment is confirmed. You will receive access via the email address provided at purchase.

License

Upon purchase, you are granted a non-exclusive, non-transferable license to use the digital product for your personal or internal business purposes. You may not:

• Redistribute, resell, or share the product with third parties
• Modify and sell the product as your own
• Use the product to create a competing product or service

Refunds

Due to the digital nature of our products, all sales are final. If you experience a technical issue accessing your purchase, contact us at info@ebygautomation.com and we will resolve the issue promptly.

3. Implementation Services

Scope of Work

All Jeong AI implementation services are governed by a separate Statement of Work (SOW) or service agreement that outlines the specific scope, deliverables, timeline, and payment terms. These Terms apply in addition to any individual service agreement.

Client Responsibilities

Successful implementation requires your cooperation. You agree to:

• Provide timely access to necessary systems, tools, and information
• Designate a point of contact for project communication
• Review and provide feedback on deliverables within agreed timeframes
• Ensure that any data or content you provide does not infringe on third-party rights

Payment

Payment terms are specified in your individual service agreement. Unless otherwise stated, implementation fees are due according to the milestone schedule in your agreement. Late payments may result in project delays or suspension of services.

4. Jeong Support Plan

The Jeong Support Plan is a monthly subscription service. By subscribing, you agree to:

• Pay the agreed monthly fee on a recurring basis
• Provide reasonable notice (30 days) before canceling the subscription

We reserve the right to adjust pricing for the Support Plan with 60 days' written notice. You may cancel before the new pricing takes effect without penalty.

5. Intellectual Property

Our Property

All content on our website, digital products, frameworks, methodologies (including the Capture → Translate → Deploy → Optimize framework), branding, and proprietary materials remain the property of EBYG Media LLC.

Your Property

You retain ownership of your business data, processes, and proprietary information. Any AI systems, automations, or workflows built specifically for your business during implementation become your property upon full payment, subject to the following exception: underlying templates, frameworks, and methodologies used to build those systems remain our intellectual property.

Case Studies and Testimonials

We may request permission to use anonymized results or testimonials from your engagement for marketing purposes. We will never use your name, business name, or identifiable details without your explicit written consent.

6. Confidentiality

During the course of our engagement, both parties may share confidential information. We agree to:

• Protect your confidential business information with reasonable care
• Use your information only for the purpose of delivering our services
• Not disclose your confidential information to third parties without your consent

This obligation survives termination of the engagement.

7. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability for any claim arising from our services shall not exceed the total amount you paid to us in the 12 months preceding the claim.
• We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost revenue, or business interruption.
• We are not responsible for the performance, uptime, or changes to third-party platforms (e.g., email providers, CRM systems, AI platforms) that our systems integrate with.

8. Disclaimer of Warranties

Our website, products, and services are provided "as is" and "as available." We make no warranties, express or implied, regarding:

• Specific business outcomes, revenue increases, or time savings
• Uninterrupted or error-free operation of AI systems
• Compatibility with all third-party tools or platforms

While we strive to deliver excellent results, outcomes depend on many factors including your business context, team adoption, and the tools involved.

9. Indemnification

You agree to indemnify and hold harmless EBYG Media LLC, its officers, employees, and agents from any claims, damages, or expenses arising from your use of our products or services, your violation of these Terms, or your violation of any third-party rights.

10. Termination

We may terminate or suspend access to our services if you violate these Terms or fail to make required payments. Upon termination of an implementation engagement, you will receive all completed deliverables for which payment has been made.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the State of Texas.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.

13. Free Automation Audit

The free Automation Audit is a complimentary consultation with no obligation to purchase. Information shared during the audit is treated as confidential and governed by the confidentiality provisions in these Terms.
